OpenSSH 5.0p1 base code has functionality to use server alive messages to determine whether server is alive. It doesn't work correctly.  If setting ServerAliveCountMax and ServerAliveInterval, the connection won't disconnect when the threshold is reached. 


I have reported it to the openssh maillist.

put this on the 5.1 list and set a more reasonable severity
